Child Support and Maintenance in the UAE: An Overview
Maintenance, sometimes called alimony or support, is financial support owed within a family. In the UAE it can include support for children and, in some circumstances, a spouse.
The law that applies depends on the family's circumstances, and rules and practice have evolved, so this guide is general.
Child support
Parents are generally responsible for supporting their children. Courts consider the child's needs and the parent's means, including education, housing, health care and daily expenses.
Spousal maintenance
Whether a spouse or former spouse can claim support, and for how long, depends on the applicable law and the facts of the marriage and its end.
What the court may consider
- Each party's income and obligations
- The child's age, education and health needs
- The standard of living and residence arrangements
- Any existing agreements or orders
Evidence
Collect payslips, bank statements, tenancy documents, school fee invoices and medical costs. Clear records make claims easier to assess.
Agreements
Parents sometimes agree on a payment schedule. If so, record the agreement carefully and consider whether it should be submitted to the court so it can be enforced.
Enforcement
If an order is not complied with, enforcement steps may be available through the court's execution process. See enforcement overview. Travel and other measures may be available in some situations under the rules.
Changes in circumstances
Orders can sometimes be reviewed if circumstances change significantly, for example loss of income. Do not stop paying without legal guidance.
How a consultation can help
A consultation can explain the framework, review your documents and consider options. Court proceedings are conducted by licensed advocates or other authorised professionals, and amounts cannot be predicted.
Frequently asked questions
Is child support automatic?
Not unless an order or agreement exists. A claim or agreement is generally needed.
Does support continue after the child turns 18?
It can depend on the law and circumstances such as continuing education. Check the current rules.
Can I claim support if my spouse lives abroad?
Possibly, but enforcement across borders is more complex.
