UAE Dispute Resolution Options: Courts, Arbitration, Mediation and Settlement
When a dispute arises in the UAE, there is usually more than one way to resolve it. Understanding the main options helps you avoid being pushed into a route that does not suit your goals.
The routes are not mutually exclusive: many disputes involve negotiation first, then a formal process, and settle along the way.
Negotiation and settlement
Direct discussion, often with written proposals, is the cheapest route and keeps control with the parties. A settlement can be recorded in a written agreement, as discussed in settlement agreement review.
Mediation and conciliation
A neutral person helps the parties find a solution. Some disputes before the onshore courts pass through an amicable settlement stage before a claim proceeds, depending on the type and value of the claim. See mediation and conciliation.
Onshore courts
The federal and local courts hear civil, commercial, labour and family matters. Proceedings are in Arabic, and appearance before the courts is carried out by licensed advocates. Court procedure is governed by the Civil Procedure Law and related rules.
DIFC and ADGM courts
DIFC and ADGM have their own courts that use English and a common-law style framework. Their jurisdiction depends on the free zone's rules and the parties' agreement.
Arbitration
Parties may agree to refer disputes to arbitration, for example at DIAC, or under the Federal Arbitration Law (Federal Law No. 6 of 2018). Arbitration offers choice of arbitrators and confidentiality, but it requires a valid agreement and has its own costs. See arbitration versus litigation.
