Employment Contract Review in the UAE: What to Check
An employment contract sets out the terms of the relationship between employer and employee. Because the UAE Labour Law contains mandatory provisions, a contract cannot simply remove protections the law gives, but the contract still determines many practical points.
This guide is for employees and employers. Free zones such as DIFC and ADGM have their own employment regulations, so check which framework applies first.
Which law applies
Private-sector onshore employment is mainly governed by the Labour Law (Federal Decree-Law No. 33 of 2021, as amended) and implementing regulations. Free zones may have their own rules. The contract should be consistent with the applicable framework.
Core terms to confirm
- Names and capacities of employer and employee, and job title
- Term of the contract, such as fixed-term, and renewal
- Salary, allowances and how they are paid
- Working hours, leave and public holidays
- Place of work and any right to relocate
Probation and notice
Check any probation period, which the law limits, and the notice period for termination by each side. Make sure terms are not less favourable than the law requires. See probation and notice periods.
Termination and end-of-service
Review the grounds for termination and how end-of-service dues are calculated. See end-of-service disputes.
Restrictions
Confidentiality, non-compete and non-solicitation clauses can affect your future work. See employee non-compete clauses.
Documents and registration
Contracts are typically registered with the labour authority, and the registered terms should match the signed offer. Differences between the offer letter and registered contract are a frequent source of disputes.
How a consultation can help
A review can compare the terms with the applicable framework and highlight unclear or unusual clauses. It does not guarantee how an authority or court will treat a particular term.
Frequently asked questions
Is an offer letter the same as a contract?
Not necessarily. Check what the offer letter says and whether it is meant to be replaced by a formal contract.
Can an employer change my terms?
Changes generally need agreement and must comply with the law. Review the contract and seek guidance before accepting changes.
Do I need a copy in Arabic?
Check what is required for registration. For disputes, Arabic documents or translation may be needed.
